Unpleasant, but not harmful to health: the corona smear. However, a couple of parents in Milan refused to have their terminally ill child blood drawn.

The smear was mandatory for transfer to a special clinic.

The public prosecutor therefore ordered that the sample be taken “by force”. But that required legal tricks.

  • A four-year-old boy from Milan suffers from an aggressive tumor.

  • He must be transferred to a special clinic. A corona test is mandatory for this.

  • Parents refuse to give consent for the smear test – the clock is ticking.

Whether you are vaccinated against Corona is and remains a voluntary matter – however whether you get tested for the virus is mandatory in certain contexts. For example, in the case of admission to certain clinics. The smear itself is unpleasant, but not harmful to health. However, a couple from Milan refused to test their four-year-old son despite the fact that the child was a matter of life and death. This was reported by “Corriere della Sera”.

The child suffered from a dangerous tumor and would have to be transferred to a special clinic – only there could she be helped. As there are many immunocompromised children in the ward, Covid testing is mandatory. But the parents did not want the “operation”, which lasted a few seconds, to be performed on their son. The clock kept ticking, every minute counted to save the child’s life.

Prosecutor forces smear

As the boy’s life is in danger, the doctors denounced the Public Ministry. But then the next problem arose: there is no law that requires the collection of biological samples from children, this is only possible for other medical tests.

For this reason, investigative prosecutor Nicola Rossato had to allow himself legal cheating: he applied paragraph 359 of the Italian Code of Criminal Procedure, according to which biological samples can be forced to be collected if the success of the investigation is compromised.

Although there were no previous investigations, they are initiated pro forma against the parents – for attempted murder. The decree was treated as urgent, the boy can be crossed out and, with luck, successfully treated.
