A California judge has denied James Tupper’s application to be appointed his son’s barrister.
According to Page Six documents, the court found that Tupper – who shares Atlas with Anne Heche – had not presented enough evidence to prevent Homer Laffoon from becoming his half-brother’s legal guardian.
Following the verdict, Laffoon’s attorney, Bryan L. Phipps, told Page Six in a written statement, “We are pleased – but not surprised – by the court’s decision this morning to deny James’ application to be appointed coroner for Atlas. We look forward to the court deciding Homer’s application at the next hearing, and in the meantime, Homer will continue to diligently administer the estate in accordance with his powers as special administrator.”
The next court hearing will take place on November 30, 2022.

Immediately thereafter, Tupper attempted to stop Homer by claiming that “As a minor, Atlas is unable to hire counsel to represent his interests in this proceeding.”
He added that he is Atlas’ only living parent, they live together and he loves his son “very much”.

Tupper not only asked the court to appoint him his son’s legal guardian, but also claimed he was the executor of Heche’s estate, according to an email she sent him in 2011.
“I wish that all my assets pass under the control of Mr. James Tupper to use in raising my children and then give to the children,” he claimed she wrote in the alleged will.

However, Homer fired back, claiming the alleged will was not valid because it “was not signed by [Heche] and does not have two witnesses who signed the document meanwhile [her] Lifespan.”
The ‘Six Days Seven Nights’ actress died on August 12 after a car accident on August 5 that left her in a coma. She was 53.
