Jamie Foxx has denied sexual harassment allegations made against him in a new lawsuit.

On Wednesday, an anonymous woman in New York filed a lawsuit against the Oscar-winning actor, accusing him of sexually assaulting her at the Catch Rooftop bar in New York in August 2015.

In response to the allegations, the star’s rep announced Thursday that he plans to file a “malicious prosecution” lawsuit following the lawsuit. “The alleged incident never happened. In 2020, this person filed a nearly identical lawsuit in Brooklyn. The case was closed shortly afterwards, the spokesman told several media outlets. These complaints are no more viable today than they were back then. We are convinced that they will be rejected again. And once that occurs, Mr. Foxx intends to file a criminal complaint for malicious prosecution against this individual and his attorneys for re-filing this malicious complaint.”

In court documents, the woman claimed she and a friend started a conversation with the Django Unchained actor after he asked for a photo. The 55-year-old allegedly complimented the woman’s appearance and smell before taking her to a secluded area of ​​the rooftop bar. She claimed he put his hands under her shirt and touched her breasts before slipping his hands down her pants.

The accuser is suing Jamie Foxx, the restaurant and bar, and its owner, Mark Birnbaum, for damages for pain, suffering, emotional distress, anguish and humiliation.

The lawsuit was filed under New York’s Adult Survivors Act, which provides a one-year period in which victims can sue their alleged abusers, even if the statute of limitations has expired. This period ends this week.
