WASHINGTON — Jay Johnston, an actor best known for his roles on the television series Arrested Development and Bob’s Burgers, has been arrested and charged with his alleged involvement in the Jan. 6, 2021 attack on the Capitol.

A federal court in Washington, DC cleared the criminal case against Johnston after his arrest on Wednesday. He faces four federal charges, including rioting and entering or remaining in a locked building or compound.

The Daily Beast reported in December 2021 that Johnston lost his role as the voice of Jimmy Pesto on Bob’s Burgers amid suspicions of his involvement in the Capitol riots. He also appeared on “Anchorman” and “The Sarah Silverman Program.”

A warrant reviewed by CBS News said Johnston was taken into custody in Los Angeles on Wednesday.

A factual statement filed in court by an FBI agent alleged that Johnston “was part of a group of rioters who confronted law enforcement officers in the West Plaza of the United States Capitol.” The affidavit said Johnston helped move police shields amidst the crowd and also “turned around and made a series of hand gestures towards the crowd, including clapping hands, banging fists together and pointing at the Crowd.”

The indictment papers alleged that Johnston held a police riot shield over his head and “then joined other rioters in a group attack on the officers who were defending him.” [Lower West Terrace] Entry.”

The FBI affidavit included images allegedly showing Johnston with the crowd in a bitter fight against police in a tunnel leading to the Capitol:
