Koy Biermann was ordered to hand over his Rolls-Royce after failing to make payments for it, leading to a lawsuit from BMW.

A default judgment was entered against Kroy, 38, after he stopped making payments on the vehicle more than a year ago and failed to respond to the repossession lawsuit. According to court documents obtained by TMZ, the judge ruled in favor of BMW.

The former NFL player, who is in the middle of an ugly divorce from Kim Zolciak, must now immediately turn the car over to law enforcement in Fulton County, Georgia so that BMW can get it back.

BMW previously claimed that Biermann entered into a three-year lease and agreed to make monthly payments of $5,297.64 on the vehicle. The total amount he was supposed to pay over the course of the 36-month lease was $190,715.04.

But Biermann is said to have stopped making payments two years into the lease – BMW claims his last payment was made in September 2022.

BMW sued Biermann in June for a possession penalty to recover the vehicle and the unpaid money.

In its lawsuit, BMW stated that Biermann often “came short” and then did not pay at all – most recently in September 2022.

Several months after the lawsuit was filed, the company still hadn’t heard from Kroy – prompting BMW to ask a judge to repossess the car.

According to TMZ, Kroy remains silent when it comes to defending himself in the case.

This is just more bad news for the financially struggling couple as they have been forced to list their Georgia mansion as it nears foreclosure. They are asking a whopping $6 million.

They also keep moving on with their very ugly divorce.

As for their house, Kim and Kroy hope it sells quickly or the bank will take control as they are on the verge of foreclosure.

You have until November 7th to unload the sprawling property, otherwise an auction will take place on the property.

The home, which was featured on the Bravo spinoff series “Don’t Be Tardy,” features 7 bedrooms, 11 bathrooms, and amenities like a swimming pool, wine cellar, arcade, and movie theater.

According to the credit card company, the last payment Kim made to her was $4,179 – in September 2022.

Her marital problems remain severe.

A judge ordered the couple to behave civilly toward each other to protect the couple’s four young children – Kroy “KJ,” 12, Kash, 11, and twins Kaia and Kane, nine.

“Neither parent shall disparage the other parent in the presence or within earshot of the minor children,” the documents state.

Another provision stated that neither parent could monitor the other parent’s time with the children and the children could not be used as messengers between the parents.

Kroy had also legally adopted Kim’s two daughters from a previous relationship: Brielle, 26, and Ariana, 22.

In July, it was revealed that the reality TV couple had decided not to separate and had withdrawn their divorce papers from Fulton County Superior Court in Georgia. They were spotted just before attending a church together in Atlanta.

Following the second divorce filing, a source told People in October that Kim and Kroy were “still under the same roof,” but revealed that all was not well, adding, “It’s a money war right now.”

Even though they were living together, the insider explained that the estranged couple is “not trying to get back together.”

During the first two months of the separation – during which both petitioned the court for sole custody of their four younger children – Kim and Kroy argued with each other in court documents.

Kim said that Kroy smoked marijuana, which made his ability to raise their children believable; while Kroy claimed that Kim’s gambling habits had consumed her time and decimated the family finances.
