President Luiz Inácio Lula da Silva (PT) explained on Thursday 9th before the Supreme Federal Court (STF) that with this statement he “did not intend to harm the reputation, dignity or decency of Jair Bolsonaro (PL) to slander” or “to hurt”. The former president made firearm ownership more flexible “to accommodate organized crime.”

The President, through the Attorney General’s Office (AGU), responds to a request from Bolsonaro to the PT member to clarify statements made during the “Conversation with the President” on July 25. The former president can use the response as evidence to bring criminal charges for libel, slander and slander.

Three excerpts from Lula’s statements at the time displeased Bolsonaro. In the first part, the president said that “this arms clearance decree issued by the previous president served to please organized crime.” Second: “They (the Bolsonaro government) tried to prepare a coup. Sifu (sic)”. Finally, the third states that the previous government wanted to create “the Ministry of Weapons, the Ministry of Violence, the Ministry of Fake News, the Ministry of Lies.”

Bolsonaro’s lawyers asked the president to explain what the term “Sifu” means, what he meant by these three statements and whether he would say them again. The rapporteur is Minister André Mendonça, who gave Lula a deadline to explain.

The argument put forward by the AGU at the demonstration is that the President’s statements did not contain any form of illegality and that he acted within the limits of freedom of expression in political debate. “There is nothing offensive or false in the statements made in the Exordial, but care is taken to regularly exercise the right to criticism in the context of political debate,” said Lula’s response, signed by the Union Attorney General Jorge Messias among the favorites for the position left vacant by Rosa Weber’s resignation from the STF.

By saying that the President had “no intent,” the AGU declares that there was no “intent” in his statements. This is one of the legal requirements for the existence of crimes of insult, slander and slander. “It is not enough that the words can be offensive, it is necessary that they are uttered with this intention, otherwise the exercise of criticism, a manifestation of the fundamental right to freedom of expression, will be criminalized,” Messias said at the demonstration in the he represents Lula.

Bolsonaro is also filing a criminal complaint against Lula

On October 24, Bolsonaro appealed to the Supreme Court, but in a more succinct way. This time he is demanding that Lula be criminally convicted for comments he made at the ceremony marking the adoption of the Paulo Gustavo law, which the former president vetoed.

On the occasion, which took place on May 11, Lula called Bolsonaro a “paladin of discord, a champion of ignorance and a champion of denialism,” in addition to promising investigations. In his speech, the PT member also mentioned a mansion in southern California (USA) that belonged to the brother of Lieutenant Colonel Mauro Cid.

Bolsonaro accuses the PT member of insults and slander for linking him to the family villa of the president’s former aide. The case has been referred to the office of Minister Luiz Fux and is awaiting a decision from the judge.
