A background actor is suing Mia Goth, claiming she kicked him in the head and gave him a concussion on the set of the upcoming horror film “MaXXXine.”

James Hunter is also suing director Ti West and production company A24. He is seeking at least $500,000 in damages for battery and wrongful termination following the incident, which occurred in April 2023.

The lawsuit, shared by Deadline, states that Hunter was hired as a background actor for three days to play the role of “Dead Parishioner” in “MaXXXine,” the third film in a trilogy of horror films directed by Ti West and starring Goth.

The complaint states that Goth, who stars in the film, was supposed to walk past the actor, step over him and look down as he lay on the ground.

But on the fourth take, the complaint said Goth “almost stepped on Hunter,” who reported it to the second assistant director.

The assistant director then warned the star to “be careful,” the lawsuit says. But in the next shot, Hunter claims that Goth “deliberately kicked him in the head with her boot,” causing a “stiff neck” and headache.

Hunter again reported the incident to the second assistant director, who notified Goth and West.

According to the lawsuit, Hunter received no medical attention and West said filming should continue.

After the scene ended, Hunter claimed Goth visited him in a private bathroom where she “taunted” him.

“After intentionally kicking Plaintiff in the head, Defendant Goth invaded Plaintiff's privacy in a bathroom, laughed at Plaintiff, mocked, ridiculed and humiliated Plaintiff, and dared Plaintiff to do something about it,” says the lawsuit.

On the drive home from the night's filming, Hunter said he was pulled over for being drowsy and “nearly passed out twice,” the lawsuit continues.

Then, the next day, Hunter claimed he was told he had been “taken off production” and banned from set for the next two days of filming.

He was not given a reason for this, they say.

Hunter said he suffered from “head trauma symptoms” over the next two days, including memory loss, confusion and disorientation, which led to him being rushed to the hospital.

A doctor who examined him concluded he suffered a concussion from a kick to the head, the lawsuit says.

Representatives for all parties did not immediately respond to Business Insider's requests for comment sent outside regular business hours.

“MaXXXine,” which also stars Elizabeth Debicki and Michelle Monaghan, does not yet have a release date.
