A New York City sex offender arrested on suspicion of attempted murder after hitting a diner, fracturing his skull and causing a brain hemorrhage has been allowed to walk free after his charges were downgraded to a misdemeanor.
Bui Van Phu, 55, a registered sex offender who has served 24 years in prison, exited the Bronx Criminal Court Thursday afternoon after appearing before Judge Giyang An.
Convicted of attempted robbery in 1991, Phu is a registered sex offender who was on probation after being convicted of raping a 17-year-old girl at gunpoint on December 24, 1994, according to court filings viewed by became. He was released from custody in March 2019
In chilling footage released by the NYPD, Phu is seen walking out of the Bronx’s Fuego Tipico restaurant and putting on a pair of gloves.
Then you see how he hits the victim with great force on the back of the head. The victim was found unconscious and unresponsive on the ground after the unprovoked attack and was taken to the hospital.
His skull was fractured and he is suffering from a cerebral hemorrhage.

Phu, who was arrested Wednesday, had previously been convicted of first-degree sexual abuse in March 1995
Horrific surveillance video released by the NYPD captures the moment Phu donned a pair of gloves and struck with great force, hitting the victim in the back of the head.
He then immediately falls to the ground, appearing to be unconscious and banging his head on the concrete after the sudden attack. The victim suffered a fractured skull, a cracked cheekbone and bleeding in the brain, prompting EMS to take him to NYC Health + Hospitals/Jacobi.
The NYPD claims he slapped the victim in the face “without prior conversation or altercation” before “returning to the restaurant and later to parts unknown.”
The man’s condition is currently in critical but stable condition and the investigation into the brutal attack is ongoing.

An NYPD spokesman said: “Police were told that around 10:45 p.m. on Friday, August 12, 2022, police responded to an emergency call from a man who was being assaulted outside the Fuego Tipico restaurant at 163 Eat 188 Street .
“Upon arrival, responding officers discovered a 52-year-old male victim unconscious and unresponsive on the ground with trauma to the head.
“Following further investigation, the victim exited the restaurant, stood and watched as several people were talking. At that point, one person exited the restaurant, put on a pair of gloves, and stood behind the victim.
“Without prior discussion or argument, the person slapped the victim in the face before returning back to the restaurant and later to parts unknown.
“The victim suffered a fractured skull, a broken cheekbone and bleeding in the brain.
“EMS responded to the scene and transported the victim to NYC Health + Hospitals / Jacobi where his condition is listed as critical but stable. The investigation is still ongoing.”
