Pauly Shore is being sued for alleged “battery” and “assault” after a man claimed he was attacked by the star's security guards at the Comedy Store in a November 2022 incident.

In documents obtained by The Blast on Thursday, Sean Kehoe and his daughter Kirra Lyn Potts filed the lawsuit, claiming they both suffered “serious injuries” following the attack.

On the night of November 30, the two were guests at The Comedy Store in West Hollywood – which is primarily owned by Shore – when security allegedly “violently grabbed and assaulted” Kehoe.

In the lawsuit, his daughter Kirra also claimed that the Encino Man actor knew about the security guard's attack plan and “encouraged” the altercation.

She further stated in the documents that she felt “emotional distress” after witnessing her own father being attacked.

In addition to assault and battery, Kehoe and Potts are also suing the comedian for “intentional infliction of emotional distress,” “negligence,” “premises liability,” and “negligence in hiring unsuitable employees.”

The two are also seeking damages in the form of compensatory medical bills and have also asked for their legal fees to be covered.

In the documents, the father-daughter duo also demanded “repayment of all damages incurred during the incident.”

According to The Blast, the lawsuit also does not specifically state what caused the altercation.

The Comedy Store was founded in 1972 by Pauly's father Sammy Shore, his wife Mitzi and writer Rudy de Luca. The following year, Mitzi took over management of the club's nighttime operations – and died in 2018 at the age of 87.

The revelation of the lawsuit comes shortly after Pauly was cast as Richard Simmons in an upcoming biopic about the reclusive fitness star.

Before the feature, however, Shore has already appeared in the role of 75-year-old Simmons in a short film called “The Court Jester,” which will be shown during the Sundance Film Festival – although he is not included in the official cast.

Shore has even hinted to fans that his performance could potentially lead him to an Oscar in 2025.

Speaking to TMZ earlier this week on Wednesday, Pauly sent a message to Simmons in hopes of getting his blessing for the biopic film.

While at Hollywood Burbank Airport, the comedian encouraged Richard to watch the short film, telling him to “watch it with an open heart, not watch it start” and said, “I don't want to do that…” “'

He added, “Watch it with an open heart and just be vulnerable and just ask yourself, 'What do you think about this?'

“Based on that, and if you feel like it's still messed up and it's not consistent with your integrity and your thing, then let us know. But in the meantime, we'll try to move forward with this piece.”

He later added, “I would love to have Richard Simmons be a part of the feature, to be physically with me on set.”

Last year, Shore announced his intention to play the popular '80s fitness icon, known for her bubbly personality and colorful workout clothes.

“I heard everyone's reaction to my role as Richard Simmons in a new biopic, so I reached out to him,” he wrote on Facebook in September.

Simmons – who has not been seen in public since 2017 – is said to have no interest in taking part in the biopic.

Last July, Simmons made an extremely rare public statement to mark his 75th birthday.

Although he did not convey a personal message to the public and his fans, he did allow his representative to speak on his behalf.

“This is a big milestone. “I just want to see him happy, and he is,” his rep Tom Estey told ET about the special occasion.

It was a rare form of communication from the former fitness guru, who has largely hidden from the public since 2014.

He was previously spotted in 2017 when he was discharged from a hospital after being treated for a severe digestive disorder.

However, he tried to avoid being seen by covering himself almost from head to toe with a blanket, at which point his housekeeper had to lead him to a waiting car.

Despite Simmons' recent reclusive years, fans showed he was still in their hearts and minds when they stopped by his home on Thursday to personally wish him a happy 75th birthday.

Although they likely didn't see him in person, two people were seen carrying birthday balloons and a sign that read, “Happy Birthday Richard!” We love you!'

His retreat from the spotlight shocked many friends and admirers at the time and even sparked an investigative podcast, documentaries and half-hearted claims that his housekeeper had held him hostage.

Since 2014, Simmons has spoken to the public only through a few telephone interviews and rare statements from his representatives.
