“Russia is the aggressor here, and I think what we’ve seen here at the Pentagon — we’re certainly seeing clear evidence that the Russian military is committing war crimes,” Kirby told Fox and Friends on Tuesday.

“We think it is important that the investigative process continues. We will contribute. But obviously relations with Russia are not the priority, nor should they experience the unprovoked and illegal aggression that Russia has perpetrated against the people of Ukraine,” he continued.

Kirby’s comments come after the US condemned Russia for committing “war crimes” amid its war with Ukraine. The convictions mark a changed tone for US officials as images and reports show, among other things, Russian attacks on civilians.

The United Nations Human Rights Office on Tuesday reported 2,510 civilian casualties since the invasion of Ukraine began on Feb. 24, including 953 dead and 1,557 injured. However, the actual numbers are “significantly higher”.

The Pentagon spokesman said the US and other nations are documenting potential evidence to help investigators internationally determine whether Russia committed war crimes.

Kirby declined to hypothesize what would happen once these investigations were completed, but he said “there will be ramifications at an international level.”

“We see that the Russians clearly – there is clear evidence that their military – their armed forces are committing war crimes. We don’t shy away from that,” Kirby said. “I mean, you can see it for yourself in the video footage you show every day.”
