Peru Libre Segundo party congressman Toribio Montalvo Cubas presented a bill that places the State Ministry in a state of emergency and aims to implement “extraordinary measures for its institutional restructuring.”
“The purpose of this law is to place the Public Ministry in a state of emergency for the duration of its duration, thereby suspending the functions of the Prosecutor of the Nation and the Supreme Prosecutorial Committee and the… National Assembly of Prosecutors (ANF), which is composed of seven prosecutors, four of whom are elected from among the presidents of the senior prosecutor's chambers, from among their colleagues who have the status of holders; and three will be selected by the presidents of the provincial prosecutors,” the bill says.
Parliamentarian Montalvo Cubas points out that the emergency and reorganization process “is of an exceptional and temporary nature and aims to take measures to achieve objectives that improve both its organization and its internal structure”. In this sense, he indicated that the project would be financed by the Public Ministry.
“The fact that the recent publicly known events relating to allegations of corruption and organized crime, among others within the Ministry of State, are having an impact on our social coexistence and our democratic institutions, warns us of the need for urgent reform of this organ of the administrative system.” by establishing, Implementation and compliance with properly formulated and effective public policies” is cited as one of the reasons given by the legislature for submitting the PL.

The parliamentarian Montalvo, of the Pencil Party, reveals in his bill the statements of the former adviser to Patricia Benavides, Jaime Villanueva, about an alleged criminal organization that was anchored in the Public Ministry. In this sense, he mentions that “corruption influences political instability in the country” and that “this phenomenon undermines citizens' trust in the proper functioning of political institutions”.

National Prosecutor refused PL to reorganize the Public Prosecutor's Office
The nation's acting prosecutor, Juan Carlos Villena Campana, considered the bill, which proposes a reorganization of the public ministry, as “unconstitutional and arbitrary.”
“It is clearly about breaking the constitutional and democratic order, returning to the beginning of the 90s, when many prosecutors were fired from the State Department, with the consequences that we all know,” he said.
