Supreme Court EXTENDS Title 42 beyond December 27 deadline

BREAKING: Supreme Court rules Title 42 remains in effect while legal challenges are fought out

The Supreme Court ruled by a 5-4 vote to keep Title 42 just hours before it was scheduled to end at midnight Wednesday.

The Covid-era health policy, which allows border guards to expel migrants immediately, will now remain in place pending litigation over its end to courts.

Agents can now use the policy to expel border workers for at least the next few months amid an expected onslaught of migrants expected to rush the US-Mexico border after Title 42 was lifted.

Justice Neil Gorsuch joined the more liberal Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson to vote against the retention.

The Supreme Court agreed to rule later this term on whether 19 GOP-run states should be allowed to intervene to defend the policy in lower courts.
