Tom Daley, one of the greatest divers of all time, 3 world gold medals and one Olympic, and Dustin Lance Black, Oscar-winning screenwriter for the film “Milk” are one of the most famous gay couples in the world. So, at a time when surrogacy is at the center of a global debate, it could not go unnoticed that they made the birth of their second son, Phoenix Rose Black-Daley, public on social media, commenting with these words: «And now we are four. Our second son, Phoenix Rose Black-Daley, arrived on March 28, 2023 at 3:34pm. We are so happy.”
But they too, one (Daley) a British citizen and the other (Black) an American, had to adapt to the different existing legislation in the two countries and opt for American surrogacy. After all, as they explained a few years ago on the occasion of the birth of their first child: “We have investigated the topic in Great Britain and in the USA. It’s a lot more complicated in the UK because surrogates aren’t as well protected by law and the parents-to-be aren’t protected by law so it’s just not safe, there are a lot of hurdles to overcome. However, in the United States everything is regulated to ensure everyone’s safety and here too the surrogacy process is much simpler ».
Daley and Black have been together since 2014, married in 2017 and have been parents since 2018 when their first child, Robert Ray, was born. Among other things, Daley is one of the few top athletes who came out (2013) when he was still active. However, what gives us food for thought is the fact that they too, like many other couples who have had to resort to surrogacy, complain about two aspects of European legislation: the lower protection of surrogacy children and the absence of certain rules that allow them nature of motherhood.
