Former Teen Mom 2 star Jenelle Evans is reportedly separating from her husband David Eason.
The controversial 32-year-old reality star filed for a legal separation from Eason in court, The Sun reported Monday.
The move comes days after Jenelle reportedly kicked Eason out of the family home.
In her filing, Evans attributed the breakup to Eason's recent “erratic behavior” while claiming he was suffering from “substance abuse.”
The petition was filed in court on January 23, and the former MTV employee said the two officially separated on February 16 and intended “the separation to be permanent.”
Former Teen Mom 2 star Jenelle Evans, 32, has filed for a legal separation from husband David Eason in court, The Sun reported Monday
In her documents, Evans attributed the breakup to Eason's recent “erratic behavior,” “substance abuse” and “refusal to work.”
In the filing, Evans alleged that Eason refused to work to help support her family while spending excessive amounts of money.
She also says he had a “criminal conversation” with his ex-wife via text message.
Evan's filing reportedly relates to Eason's alleged attack on her 14-year-old son, Jace.
Eason was charged with child abuse and aggravated strangulation after Jace told doctors his stepfather had abused him after he tried to run away.
The alleged assault reportedly occurred at an acquaintance's home and was allegedly captured on video by a Ring doorbell camera.
A CPS investigation was also launched against the couple in the wake of the alleged abuse, but Jenelle said it was closed.
Eason's killing of the couple's French bulldog Nugget in 2019.
After Evans initially called the Columbus County Sheriff's Office to report that her husband had shot their dog, she subsequently claimed she did not see the shooting or see any evidence that the dog was actually dead.
That led police to drop the investigation into the murder, only for Eason to admit months later that he shot the small dog that he claimed had bitten their then-2-year-old daughter, Ensley Jolie.
Evans also writes that Eason overspent, and she accused him of having “criminal conversations” with his ex-wife via text message; seen in 2017 in Inglewood, California.
Evans claimed that her estranged husband had to move onto their boat due to a no-contact order with their son Jace, whom he allegedly assaulted. She claimed he had since spent his days drinking in a bar; seen in 2019 in NYC
“Throughout the duration of the parties’ marriage, defendant has exhibited troubling and sometimes troubling behavior toward plaintiff,” Evans writes.
“In May 2019, the defendant shot and killed the family’s pet French bulldog, Nugget, in front of the minor child,” she said, referring to Ensley, now seven years old.
She added that as a result of the shooting, “the Columbus County Department of Child Services, DSS, has opened a case against the parties and taken the aforementioned minor children into custody.”
She claimed that Eason's daughter, Maryssa, was also taken into custody by the DSS after the shooting.
Evans went on to reference Eason's alleged attack on her son Jace.
“On or about September 28, 2023, Plaintiff’s eldest minor child made a report to medical professionals,” she wrote.
She added that her estranged husband “was later charged with child abuse and aggravated assault by strangulation” after police investigated.
Despite the pending criminal complaint, she said DSS filed a “Notice of Involuntary Dismissal in Columbus County.”
Despite the conclusion of this investigation, Eason is not allowed to be near her son Jace while his allegations are still unresolved.
“Despite the voluntary dismissal of the underlying DSS proceedings, the defendant’s criminal case is still pending and the defendant is subject to several no-contact provisions in the above-mentioned criminal case,” she continued.
“As the DSS case was voluntarily dismissed and primary custody applies to him [Jace] fell back to the plaintiff, and the defendant left the former marital residence at the plaintiff's behest [Jace] “Could return home with the plaintiff and his siblings,” Evans said.
The reality star claimed Eason didn't contact her to see how she was doing or ask about his daughter Ensley while he walked onto their boat, which is docked at a nearby marina.
Despite his no-contact order, Eason is said to have visited her house on February 22nd. She claimed he took her vehicle without permission and “told her to kill herself.”
“Plaintiff spent his days drinking alcohol at a bar near the marina,” she claimed.
Evans also claimed that her estranged husband refused to give her the key to their home's mailbox while preventing her from picking up medication for Jace that had been sent to the home, thereby “putting the minor child at risk of adverse health effects.” was”.
Despite earlier reports that she also kicked out Eason's daughter Maryssa, 16, she criticized him for leaving his daughter with her.
She claimed that he “did not develop a plan to ensure that his two biological minor children were cared for and did not offer Plaintiff any support or assistance for any of the minor children during this time,” and she alleged that Maryssa was in charge of the household had to leave so she could focus on her son Jace after he was allegedly attacked by Eason.
Despite his no-contact order, Eason allegedly visited her home on Feb. 22, the day before the lawsuit was filed in court.
“In order to harass or annoy Plaintiff, Defendant took Plaintiff’s vehicle without her permission and, among other vile insults, told her to kill herself. The plaintiff filmed the interaction for her safety,” she claimed.
Her son Jace “was home but not present during the defendant's show,” she added.
The Sun points out that couples must be separated for a year before filing for divorce.
She asked a judge overseeing the case to make the separation permanent because Eason's alleged “excessive drinking was burdensome and made plaintiff's life unbearable.”
“The defendant regularly drank, drove and spent excess money on alcohol – money he did not earn that could otherwise benefit the financial well-being of the minor children,” she alleged.
Evans described an alleged verbally abusive environment in which her estranged husband insulted and demeaned her in front of her children and others.
Several of the incidents the reality star referred to occurred or began several years ago, but she claimed that Eason's actions significantly damaged her public reputation.
“Plaintiff has been a loyal and dutiful wife of Defendant and has stood by Defendant despite millions of people around the world expressing concern about Defendant's conduct on social media,” she wrote. “The defendant’s conduct resulted in plaintiff’s loss of employment compensation and damaged her public image.”
She is primarily seeking custody of their daughter Ensley as well as child support payments from her unemployed, estranged husband.
Evans called for an “unequal distribution” of property, apparently referring to the fact that she was the only working member of the family.
This desired distribution would include her keeping the family home.
