The Teatre nightclub, which along with La Fonda Milagros was destroyed by a fire on October 1 in which 13 people died, had all the papers in order and a contract with the DJ who organized the We are Remember party at which The Cold Fire Machine was present. The manager of the damaged nightclub, Juan IR, who was also summoned this Tuesday for investigation purposes, has refused to testify, as several sources present at the hearing confirmed to EL PAÍS. Although she was summoned at 9:30 a.m., Eva M. arrived in the City of Justice about 10 minutes later, covered in large sunglasses, a mask and a scarf, not caring about the numerous journalists waiting at the entrance to the courts . He also left without giving an explanation and his lawyer, José María Caballero, limited himself to making sure that “everything was in order in the theater hall”, which was confirmed by the lawyer Francisco Javier Verdú, who represents the owner, The other damaged room, La Fonda Milagros, where the 13 victims died, was confirmed.
According to this lawyer, Eva M. stated that all the papers were in order at the Teatre Hall, although the city council recognized that the nightclub had a current order to cease operations, which was not complied with. In addition, he has stated that he will present the contract that he allegedly signed with Carlos R., the DJ who organized the party that evening at the Teatre and to whom, according to his lawyer Raúl, he tried to assign responsibilities to Pardo- Geijo complained that there was no regulation on the use of the cold fire machine as it was not considered a “dangerous activity.” This way, and according to their reasoning, the DJ would have no responsibility for the fire, regardless of whether he had hired the owner of the machine or not.
It is the same line he took last Tuesday in his testimony before the judge, who also heard the version of the owner of the spark machine, both of whom were under investigation in the case. Lawyer José Manuel Muñoz Ortín, who represents part of the families of the deceased, has confirmed that Eva M. focused her testimony on assigning responsibilities to the DJ, claiming that she only provided the space and a percentage of the I consumed drinks at the party.
In his opinion, the club's leaders “missed the opportunity for us all to understand the conditions in which the clubs found themselves”, which he said was tolerated by the administration. For the lawyer, this trial consists of two keys: on the one hand, determining “the causes of the fire” and, on the other hand, the “causes of death” of the 13 victims. In the coming weeks, the owners of the Teatre, Marcos M., and La Fonda Milagros, Daniel R., will also be called to the investigation and will testify on February 6th and 13th, respectively.
