The civil police of Rio de Janeiro completed the investigation into the attack of actor Kayky Brito in the early hours of September 2nd and decided to close the investigation. According to the final report from the 16th Police Station (Barra da Tijuca), the driver involved in the accident was driving below the speed limit in the Posto 6 section of Avenida Lúcio Costa in Barra da Tijuca, West Zone of Rio.

Police investigations revealed that Diones Coelho da Silva, the app driver, was driving an average of 48 km/h at the time of the collision, while the maximum speed limit on the road is 70 km/h. Delegate Ângelo Lages, head of the 16th DP, called for the case to be dropped, claiming there was no evidence that the driver had committed a crime.

The police report from the Instituto Criminalista Carlos Éboli (ICCE) indicated that the driver was less than 10 meters from the actor and 0.73 seconds from Kayky when he crossed the street. According to experts, in order to have sufficient reaction time and avoid a possible collision, the initial distance between the driver and pedestrian should be more than 26 meters.

“The report is insightful and there are no doubts. The distance between the car and the accident victim at the moment of crossing, even at a speed below the permitted speed, was not enough for the driver to notice, react and stop the vehicle without noticing the effect,” explains Delegate Lages.

In addition, the investigation report highlighted that the driver did not report any changes in the alcohol consumption test or related to the use of illegal substances. He also drove the car carefully and his immediate actions to avoid the collision were noted by authorities.

The 16th DP will refer the investigation to the public prosecutor’s office, which will judge the final dismissal of the case based on the police’s conclusions.

Actor Kayky Brito suffered polytrauma and head trauma and was hospitalized for 25 days at the Copa D’Or Hospital in the South Zone of Rio de Janeiro. He was discharged from the intensive care unit on the 22nd.
