Given the solidity of that statement, the hesitation of Alves, who according to court sources offered up to three different versions in an appearance that barely lasted around 45 minutes. In response to questions from the judge, he said he was in the bathroom when the girl entered and that there had been no contact. In response to questions from the prosecutor, he clarified that when she entered the bathroom, he stood there not knowing what to do. In the prison regulations, the judge highlights these contradictions as another element in the decision-making process. The agents took statements from various witnesses and analyzed the surveillance cameras, which, while not showing the rape because it took place in the bathroom, provide relevant contextual information.
The judge eventually ordered Alves’s detention on suspicion of absconding, as requested by prosecutors and the victim’s attorney, and despite him volunteering to testify from Mexico, where he is currently playing. The judge assumes that the footballer could be tempted to leave Spain given the seriousness of the facts – a sexual assault like the one investigated here carries prison terms of between four and twelve years. Even more so when other factors are taken into account: that he has no roots in Spain, that he is a Brazilian national (a country with which Spain has no extradition treaty) and his enormous economic capacity. The prosecutor recalled that with her fortune she could even rent or buy a private plane and leave the country without having to show her passport.
