Trump claims immunity and prosecutors move to dismiss lawsuit

Former President of the United States, Donald Trumpfiled a lawsuit claiming he should not be the subject of criminal charges related to his efforts to overturn his defeat in the 2020 presidential election. In short, Trump claims immunity, but this Saturday (30) US prosecutors asked to convene a federal appeals court to reject this action.

Jack Smith, the special prosecutor in charge of prosecutions, noted that there is no support in the U.S. Constitution or U.S. legal tradition for granting former presidents “absolute immunity” from criminal charges arising from actions taken taken during her term of office. He further stated that the introduction of such legal protection would give these persons a higher status than the law.

Meanwhile, Trump claims immunity and claims that the presidency enjoys this absolute protection from prosecution.

Smith claimed that the separation of powers makes it clear that a former president could face such charges, “including, most critically, illegal acts to remain in power despite an electoral defeat.”

Trump's problematic situation in the election scenario

Donald Trump is the frontrunner among potential 2024 Republican candidates. He is seeking to overturn a lower court ruling that rejected his attempt to disprove election allegations based on his immunity claim.

In a Dec. 23 document, the former president's lawyers suggested that impeaching Trump for conduct related to his official duties would damage the integrity of the presidency. In this scenario, the issue is scheduled to be discussed on January 9 by a panel of three judges on the U.S. Court of Appeals for the District of Columbia Circuit.

Trump claimed that prosecutors were acting out of political motivation to harm his campaign in the 2024 election. It is worth noting that the disputes will begin on January 15.

The significance of the court's ruling depends on whether Trump is tried in March as planned. Progress in the case has been paused while the appeal seeking immunity from Trump is pending.

Earlier this month, Smith called on the U.S. Supreme Court to resolve the matter immediately to prevent Trump's attempt to delay. The Supreme Court rejected the request and the matter is now under the jurisdiction of the Washington District Court.
