The United States government this Wednesday, May 10, enacted a new regulation restricting access to asylum at the border with Mexico, replacing Title 42, a Trump administration rule requiring expeditious return of migrants possible spread of the coronavirus.

The rule, which will be published in the Federal Register on Wednesday, qualifies migrants who cross the border irregularly and who have not sought protection in a third country during their trip to the United States as “ineligible” to file an asylum application, government officials said over the phone reporters.

This new restriction is part of measures that will come into effect at the Mexico-United States border starting Thursday, May 11, when Title 42, which has deported more than 2.8 million migrants over the past three years, is lifted became.

New way to apply for asylum in the US

From now on, the main legal way to seek asylum in the United States will be through the mobile application CBPOne, which allows migrants to schedule appointments with authorities to present their case.

The United States will offer around 1,000 daily appointments to seek asylum through this process, a number officials say could increase “depending on the capacity” of Migration Service staff.

Those who do not use this procedure and decide to cross the border irregularly will be declared ineligible to apply for asylum in the United States unless they have previously been denied asylum in a third country or provide evidence that they encountered technical or language barriers to access the application.

Individuals found not to be eligible for asylum may be deported, denied entry to the United States for five years and face criminal charges if they attempt to re-enter the United States, said Officer.

In fact, they also stated that the United States had increased the number of deportation flights to countries in the region and had also reached an agreement with Mexico, according to which the neighboring country would take in up to 30,000 deported migrants from Venezuela, Haiti, Nicaragua and Cuba every month.

Immigrants and the credible fear interview

People who are arrested crossing the border and who are given the opportunity to present their asylum claim in a “credible fear” interview must do so during detention.

“We have hired about 1,000 asylum officers and will be ready to conduct credible fear surveys at the border starting Thursday,” another official said.

As part of the increase in personnel, the US government will send around 400 “volunteers” and around 24,000 “police officers” to the border.

Several NGOs, including Human Rights Watch, slammed the rule, announced Wednesday, May 10, while it was still in the public comment stage, calling it a “violation of human rights and international law.”
