US presidential election 2024: Justice declares Donald Trump unelectable in Colorado

The former president and Democratic primary candidate will appeal to the United States Supreme Court, one of his spokesmen announced.

The Colorado Supreme Court declared Donald Trump ineligible for the presidency on Tuesday, December 19, in a ruling that affects only that Midwestern state. With a majority of four out of seven judges, the court upheld the first instance decision and concluded that the ex-president “engaged in a rebellion on January 6, 2021.” That day, hundreds of his supporters stormed the Capitol to prevent the certification of Joe Biden's presidential victory. The Colorado Supreme Court also held, contrary to the first instance decision, that the 14th Amendment, which sought to invalidate Donald Trump, did in fact apply to a president.

The justices, “aware of entering uncharted territory,” ordered election authorities to remove the billionaire's name from the ballot for Colorado's Republican Party primary heading into the 2024 presidential election. However, the state Supreme Court suspended this injunction until January 4, the deadline for validating primary votes. “If appealed to the Supreme Court [fédérale] “Before this suspension expires, it will remain in effect and the election official must continue to place President Trump’s name on the 2024 primary ballot until she receives an injunction or mandate from the Supreme Court,” their ruling said.

Donald Trump will be tried multiple times in 2024

A spokesman for Donald Trump immediately announced that the former president would appeal to the US Supreme Court. Pending a possible decision by the country's highest court, observers assume that Donald Trump's name should appear on the ballot in Colorado on March 5th. This Super Tuesday, around fifteen states will vote for the Republican primaries.

According to poll aggregator website FiveThirtyEight, the billionaire is currently well ahead of his party's primary voting intentions. However, his campaign risks being disrupted by the trials he must appear at in 2024. Specifically, he is being charged by a federal prosecutor with “conspiracy against the United States” and for his role in the attack on the Capitol. The hearing is scheduled to begin on Monday, March 4, on the eve of Super Tuesday in Washington.
