Singer Victor Chaves of the former duo Victor & Lo has been ordered to pay R$21,000 in compensation to a street vendor who was harassed while selling drinks at a concert by the duo in Sarzedo, in the Belo Horizonte metropolitan area. The case took place on May 17, 2012, but the verdict came only on December 30 last year.
According to the defense, the street vendor authorized to sell on the show was working under an umbrella when he began to feel offended by the duo’s fans. The defendants said he “obstructed the view of several people attending the event”.
Local security tried to pull him out and he fought back. At that moment the show was interrupted and Victor ordered him to withdraw. Since he disobeyed, the singer would have started calling him “mentally weak”, “brainless”, “ignorant” and “nego”. The defense claims the seller felt humiliated.
He had the crate with the drinks confiscated by the security service. At the end of the show, the street vendor went into the dressing room and received R$3,000 from the singer Leonardo and the drinks were returned.
The judge who handed down the sentence was aware that there was excess on Victor’s part. “The show took place in a public place with a significant number of people, and the singer with his lofty behavior exposed the author to an annoying situation and psychological pressure.”
The responsibility of the company “Vida Boa”, which organized the show, was also highlighted in the sentence. She was “responsible for the proper allocation of street vendors authorized to work at the location before the audience arrives and the show begins”. The client was the municipality of Sarzedo.
“Consequently, I award compensation for moral damages of R$ 21,000.00 (twentyone thousand reais), say seven times the value of the material compensation granted at the time for the impossibility of selling beer during the show,” ruled the judge André Luiz Pimenta, from the 2nd Civil Court of Ibirit.
