When you become the owner of property, or when new owners settle near your home, you may need to negotiate “easements”. It is a right affecting property in favor of another property or person, such as a right of way.
We met real estate notary Me Jérémy Janelle-Taillefer, member of the Chambre des notaires du Quebec, to clarify this notion.

You should know that a right of way is never acquired over time. Even if your neighbor has given you his lake or forest access property for 25 years, if he sells his property to someone else – without negotiating a right of way with a notary – you could lose access to this outdoor playground.
That’s why it’s important to be careful when buying property and negotiating a right of way.
