The Rio de Janeiro judiciary ordered Xuxa to pay a little over R$65 million in compensation to a Minas Gerais businessman for plagiarism. The creator of the Turma do Cabralzinho project, which celebrated the 500th anniversary of the discovery of Brazil, accuses the presenter of plagiarizing him by introducing Turma da Xuxinha.
Originally, Xuxa was ordered to pay R$12 million, but the amount increased more than fivefold due to interest accrued during the trial, which began in 2004. To determine the current amount, an expert calculated the value of the royalties and other amounts to which the entrepreneur would be entitled based on, among other things, the magazine circulation, the rendering of characters in various products, market research.
In the decision, Judge Flávia de Almeida Viveiros de Castro, dated 6. Civil Court of Barra da Tijucapoints out that the verdict became final in 2016, but the execution of the payment of the “lost profits” to which Xuxa was sentenced did not take place because “the accused has long distorted compliance with the sentence with maneuvers that often go beyond the good Process engineering beyond”, including “unethical manoeuvres, suspicions against the expert, suitable specialist”.
