The Portuguese Commission for Equality and Against Racial Discrimination (CICDR) informed GLOBO that it was aware of the case that took place last Saturday with the children of Giovanna Ewbank and Bruno Gagliasso in Costa da Caparica, “and from this point of view we admit that given the facts, we may constitute unlawful acts of a criminal nature for which prosecutors have jurisdiction.” While the family was at a restaurant, a woman reportedly called the children “filthy niggers” and asked them to leave. The crimes would have happened also aimed at a family of Angolan tourists who were arrested by the police at the time but have since been released.

In criminal law, there is the offense of discrimination and incitement to hatred and violence, which can also serve as a qualifying or aggravating circumstance for other crimes motivated by it, such as: persecution and forced marriage.

As for the Law of Mere Social Order, the CICDR analyzes the case and implements its legal framework or sends the complaint to the competent body. If the discriminatory practice is confirmed, the judiciary can impose a conviction with a fine or reprimand, or if not, stay the case.

According to the Portuguese National Republican Guard, the incident recorded on Saturday “fits the situation in question”.

“Guard patrol immediately moved to the scene where a 57yearold woman was arrested and several witnesses were identified at the scene,” he said in a statement, adding that “a formal complaint was later filed” and the facts were “referred to the Court of Almada”.
